Estate planning is the process by which couples or individuals structure their affairs to coordinate the transfer of their assets upon death. Once the appropriate estate plan is in place, we structure our clients’ financial affairs to coordinate their assets with the new estate plan. Preparing a will and/or revocable trust does not ensure that all assets will flow as expected upon death. Each account may have a beneficiary designation, payable on death designation, transfer on death designation or joint ownership component. If not properly coordinated with the client’s estate plan, these designations can frustrate the objectives the plan is intended to achieve. We make sure that doesn’t happen to you.
Tax planning, as a part of estate planning, is unique because it involves the intersection of income taxes, estate taxes, gift taxes and generation skipping taxes. We counsel our clients on the tax implications of their plans.
In addition to wealth transfer planning, we work with clients to prepare documents to address potential incapacity during life. Virtually every estate plan includes a durable power of attorney for financial matters and a health care power of attorney. These critical documents allow individuals to avoid a court-supervised guardianship by naming a trusted person to make financial decisions for them and also name the same, or different individual, to make health care decisions if necessary.
